Subject: ASSET FREEZE OF DEFENDANT'S DURING PENDANCY OF LEGAL PROCEEDINGS
Dear Sirs,
In the interest of Anita Matilde Fernandez, and the pending Bills of review, we respectfully request Counsel, representing Mrs. Fernandez, to file necessary documentation requesting the assets of Defendants: John G & Marie Stella Kenedy Memorial Foundation, John G Kenedy Jr. Charitable Trust, & Sarita Kenedy East Foundation be frozen during the pendency of these legal proceedings to preserve monies or assets of any kind or nature, wherever situated, for proper charitable purposes. Unless an asset freeze is granted, said assets of Defendants may be lost, altered, removed or materially injured. Furthermore, Mrs. Fernandez contends the Attorney General must act expediently in the interests of the STATE OF TEXAS and the public in ordering an asset freeze in light of the harmful activities of Defendants including gross mismanagement, breach of fiduciary duty to the public and statements made by CFO S. Paul Baen in a court deposition referring to the Kenedy Foundation being operated in the inefficient and greedy manner till it “Becomes another Enron”.
